A legal dispute has emerged as a woman pursues a lawsuit against renowned US actor Jamie Foxx, asserting that he sexually assaulted her at a New York City restaurant approximately eight years ago. The legal action contends that Foxx, birth name Eric Marlon Bishop, engaged in inappropriate touching when the woman sought a photograph with him. The accuser is seeking damages on grounds of “sexual assault, abuse, assault and battery.”
In response, Foxx’s representative vehemently denies the allegations, pointing to the dismissal of a comparable lawsuit filed three years ago. The incident in question is reported to have transpired in 2015 at Catch NYC. The lawsuit extends its scope to include the restaurant owner, Mark Birnbaum, accusing him of negligence in safeguarding the plaintiff.
According to the legal filing, Foxx, appearing intoxicated, not only agreed to the photograph but also made remarks about the woman’s physique and fragrance. Subsequently, he is alleged to have led her to a secluded area in the restaurant, where he purportedly touched her breasts and placed his hands in her underwear without her consent. The incident reportedly concluded when the woman’s friend came in search of her.
The lawsuit also asserts that, as a result of these alleged actions, the woman has endured and continues to suffer severe emotional distress, anxiety, humiliation, embarrassment, post-traumatic stress disorder, and various other physical and emotional damages.
It’s worth noting that this legal action emerges just before the expiration of the New York Adult Survivors Act, a legislation that allows individuals alleging sex crimes to sue even after the statute of limitations has expired. Foxx, who earned a Best Actor Academy Award for his role in the 2004 film “Ray,” has stated his intention to counterclaim for malicious prosecution.
